In such a case, the parties must, as far as possible, replace the canceled stipulation with a valid stipulation corresponding to the spirit and the object of these presents.
Failure by the Publisher to exercise the rights granted to it herein shall in no way be interpreted as a waiver of the assertion of said rights.
